These Terms and Conditions (“Terms”) apply to the use of the FixitPR website and to all services provided by FixitPR (“we”, “us”, “our”) to our clients (“you”, “your”). By using our website or engaging our services, you agree to these Terms. Where we have signed a separate proposal or agreement with you, that document applies together with these Terms, and it takes priority if the two differ.
1. Our Services
FixitPR provides digital marketing, social media management, paid advertising (including Google, Meta, TikTok, YouTube and LinkedIn ads), search engine optimisation (SEO), website design and development, e-commerce, hosting and maintenance, content creation, brand activation, events, influencer marketing, public relations and related consultancy services. The exact scope, deliverables and timelines of your project are set out in your quote, proposal or package.
2. Quotes, Proposals and Pricing
- Quotes and proposals are valid for 30 days from the date issued unless stated otherwise.
- Prices on our website are starting prices for guidance. Your final price is confirmed in writing after we understand your requirements.
- Unless stated otherwise, prices exclude VAT and any third-party costs such as advertising spend, domain names, premium plugins, stock images, printing, venues or travel.
- Work outside the agreed scope is quoted separately before we start it.
3. Payment Terms
- Website, e-commerce and other one-off projects require a deposit (usually 50%) before work begins, with the balance due before the site goes live or files are handed over.
- Monthly services (such as social media, ads management, SEO and email marketing) are billed monthly in advance.
- We accept M-Pesa and bank transfer. Payment is due within 7 days of the invoice date unless agreed otherwise.
- Where payment is overdue, we may pause work, campaigns or hosting until the account is settled.
4. Your Responsibilities
To deliver on time, we rely on you to provide accurate information, content (text, images, logos), access to accounts and timely feedback and approvals. Delays in providing these may move project timelines. You confirm that any material you give us is yours to use or that you have permission to use it, and that it is lawful and accurate.
5. Revisions and Changes
Each package includes the number of revision rounds stated in your quote or package. Additional revisions, or changes to the agreed scope after approval, may be charged at our standard rates. We will always tell you before any extra cost is incurred.
6. Advertising and Third-Party Platforms
Advertising platforms (such as Google, Meta, TikTok and LinkedIn) and other third-party services set their own policies, approvals and charges. Advertising spend is paid to the platforms and is separate from our management fees unless your package states otherwise. We are not responsible for account suspensions, ad rejections, price changes or outages caused by third parties, but we will help you resolve them.
7. Results
We work hard to grow your visibility, leads and sales, but results depend on many factors outside our control, including your market, competition, budget, product and platform algorithms. We therefore do not guarantee specific rankings, traffic, leads, sales or returns. Any estimates (including estimated ROI) are indications based on experience, not promises.
8. Ownership and Intellectual Property
- Once you have paid in full, you own the final deliverables we create specifically for you, such as your website design, content and creative assets.
- Third-party items (for example themes, plugins, fonts and stock images) remain subject to their own licences.
- Our own tools, templates, methods and know-how remain ours.
- Unless you ask us not to, we may show the work we did for you in our portfolio and marketing.
9. Hosting, Domains and Maintenance
Where we provide hosting, domains or maintenance, these renew for the period stated in your package. Renewal fees are payable before the renewal date to avoid interruption. We are not liable for interruptions caused by hosting providers, domain registries or circumstances beyond our control.
10. Confidentiality
We keep your business information, account access and any confidential material you share with us private, and use it only to deliver our services. We ask that you also keep our proposals, pricing and strategies confidential.
11. Data Protection
We handle personal data in line with the Data Protection Act, 2019 of Kenya. Please see our Privacy Policy for details of how we collect and use personal information.
12. Cancellation and Termination
- Monthly services may be cancelled by either party with 30 days’ written notice, unless a minimum term was agreed.
- If a one-off project is cancelled after work has started, deposits are non-refundable and work completed up to the cancellation date is payable.
- We may end services if invoices remain unpaid or these Terms are seriously breached.
13. Limitation of Liability
To the extent allowed by law, our total liability to you for any claim is limited to the fees you paid us for the specific service concerned in the three (3) months before the claim. We are not liable for indirect losses such as loss of profit, revenue, data or business opportunity.
14. Use of This Website
The content on this website is for general information. We try to keep it accurate and up to date but may change it at any time. Links to other websites are provided for convenience and we are not responsible for their content.
15. Changes to These Terms
We may update these Terms from time to time. The latest version is always published on this page, with the date it was last updated.
16. Governing Law
These Terms are governed by the laws of Kenya. We will always try to resolve any disagreement amicably first; any dispute that cannot be resolved this way will be handled by the courts of Kenya.
